Welcome to Training Point. These Terms of Service explain the general conditions for using our website, submitting inquiries, and participating in services offered by Training Point LLC (“Training Point,” “we,” “us,” or “our”).
By using our website or purchasing or participating in our services, you agree to these Terms, as applicable. Specific membership agreements, waivers, and program enrollment terms may contain additional conditions that govern your participation.
1. About Training Point
Training Point is a fitness facility located at 3435 Shelby Street, Indianapolis, Indiana 46227.
Our services may include 24/7 gym access, general fitness memberships, personal training, boxing classes, boxing fundamentals programs, day passes, and other fitness-related activities.
2. Memberships and Facility Access
Memberships provide access to the facilities and services included in the membership plan purchased.
Training Point offers 24/7 access for eligible memberships. Access may be temporarily limited due to maintenance, safety concerns, emergencies, equipment repairs, or other circumstances beyond our reasonable control.
Members must use their authorized access credentials and may not share access codes, digital keys, or entry privileges with unauthorized individuals.
Memberships are intended for the registered member or members covered by the applicable plan and may not be transferred without Training Point's approval.
3. Membership Fees and Payments
Membership pricing, enrollment fees, billing frequency, and included benefits are presented during registration or in the applicable membership agreement.
By enrolling in a paid membership or program, you authorize the payment method you provide to be charged according to the billing terms you accept at checkout.
Recurring memberships may continue until canceled in accordance with the applicable membership agreement.
Failed or declined payments may result in interrupted access or other actions permitted under the applicable agreement and law.
Training Point may change pricing for future purchases or renewals, subject to applicable agreements, required notices, and law.
4. Cancellations and Refunds
Membership cancellation procedures, effective dates, notice requirements, and any applicable fees are governed by the membership agreement accepted during enrollment.
Cancellation requests should be submitted through the process specified in that agreement or by contacting Training Point.
Refund eligibility for memberships, day passes, personal training, boxing programs, and other purchases depends on the applicable purchase terms and any rights provided by law.
Nothing in these Terms limits cancellation or refund rights that cannot legally be waived.
5. Personal Training and Boxing Programs
Personal training, boxing classes, fundamentals courses, and other coached services may require separate registration, scheduling, payment, or participation agreements.
Class schedules, instructors, availability, and program offerings may change.
Participants are expected to follow coaching instructions and applicable safety rules. Training Point may restrict participation when necessary to address safety concerns or serious rule violations, consistent with applicable agreements and law.
6. Health, Fitness, and Assumption of Risk
Exercise and physical training involve inherent risks, including physical exertion, falls, equipment-related injuries, and other potential harm.
You are responsible for choosing activities appropriate for your fitness level and health circumstances. Consult a qualified healthcare professional when appropriate before beginning or changing an exercise program.
You agree to follow posted safety instructions, use equipment responsibly, and notify staff of unsafe or damaged equipment.
Any separate liability waiver or informed-consent agreement must be reviewed and accepted on its own terms. Nothing in these Terms excludes liability where exclusion is prohibited by law.
7. Facility Rules and Member Conduct
Members and guests must treat other individuals, staff, equipment, and the facility with respect.
The following conduct is prohibited:
Sharing access credentials or allowing unauthorized entry.
Harassment, threats, violence, or discriminatory misconduct.
Intentional damage, theft, or misuse of equipment.
Unsafe behavior that creates an unreasonable risk to others.
Conduct that materially disrupts other members' use of the facility.
Training Point may take appropriate action for violations, including warnings, restricted access, or termination where permitted by the applicable agreement and law.
8. Day Passes and Guest Access
Day passes and guest privileges are valid only under the conditions stated at purchase or authorization.
A day pass does not automatically establish a recurring membership or grant permission to admit additional guests.
Guests must comply with facility rules and any applicable registration or waiver requirements.
9. Website Use and Information
Our website provides information about Training Point, memberships, programs, schedules, and ways to contact us.
We make reasonable efforts to keep information accurate, but website descriptions, pricing, schedules, and availability may change. The terms confirmed during an actual purchase or enrollment govern that transaction.
You agree not to misuse the website, interfere with its operation, or submit fraudulent information.
10. Communications and Text Messaging
When you provide contact information, Training Point may contact you regarding inquiries, appointments, memberships, payments, or services, consistent with applicable law and the consent you provide.
Promotional text messages will be sent only where appropriate marketing consent has been obtained.
Consent to marketing text messages is not a condition of purchasing a membership or service.
If you receive automated text messages from Training Point, you may reply STOP to opt out or HELP for assistance where supported. Message and data rates may apply, and message frequency may vary.
